Why this policy exists.

At LandHome Financial Services, Inc., protecting your privacy is a priority. This Privacy Policy explains how we collect, use, and safeguard your information when you visit our websites, apply for a mortgage, or opt into our SMS program. By providing information to us or enrolling in our communications, you agree to the terms below, which are designed to comply with the 2026 Telephone Consumer Protection Act (TCPA), the FCC's one-to-one consent rule, the federal Gramm-Leach-Bliley Act (GLBA), applicable state privacy laws, and CTIA Messaging Best Practices.

What we collect.

We collect only what we need to evaluate, originate, and service a mortgage loan, to communicate with you, and to comply with federal and state law. The categories below describe both the application file and the operational data tied to our SMS program.

  • Identifying information. Name, mailing address, email address, date of birth, Social Security number, and government-issued ID — collected at application as required by federal know-your-customer and underwriting rules.
  • Financial information. Income, employment history, assets, liabilities, credit history, bank statements, tax returns, and similar documentation needed to determine loan eligibility and pricing.
  • Property information. Subject property address, purchase contract, appraisal, title, insurance, and HOA documentation, where applicable.
  • Phone number. The mobile or landline number you provide to receive loan-related calls or SMS messages.
  • Message and call interaction data. SMS delivery and engagement metrics (delivery status, response keywords such as STOP/HELP, opt-out timestamps), call logs, and recordings where lawful and disclosed.
  • Consent records. Timestamps and methods of opt-in (web form, keyword reply, verbal recorded confirmation, or signed paper) retained to demonstrate compliance with TCPA and Campaign Registry rules.
  • Website usage data. IP address, browser type, device identifiers, pages visited, referring URL, and similar information collected through cookies and analytics tools (see Cookies & Tracking).

How we use it.

We use your information to deliver mortgage services and to communicate with you about your loan. We do not sell your personal information.

  • Originate and service your loan. Evaluate creditworthiness, verify income and assets, order appraisal and title, prepare disclosures, fund the loan, and (for retained loans) collect payments and answer servicing inquiries.
  • Communicate with you. Send transactional updates by email, phone, and SMS — conditional approvals, document requests, rate locks, closing logistics, and post-closing servicing notices.
  • Comply with regulation. Provide TILA-RESPA disclosures, ECOA appraisal copies, GLBA privacy notices, HMDA reporting, BSA/AML monitoring, and TCPA / Campaign Registry recordkeeping.
  • Improve our services. Measure messaging engagement, diagnose website issues, and enhance the application experience — using aggregated and pseudonymized data wherever practical.
  • Prevent fraud and protect the file. Verify identity, detect suspicious activity, and protect against unauthorized access to your loan record.

SMS & text messaging.

Our SMS program is operated under the 2026 TCPA, the FCC's one-to-one consent rule (effective January 2024 and reaffirmed for 2026), Campaign Registry requirements, and CTIA Messaging Best Practices. The terms below summarize the rules that govern any text message we send you.

One-to-one consent.

Your opt-in applies solely to LandHome Financial Services, Inc. Under the FCC's January 2024 ruling, we do not share your SMS consent with third parties, lead vendors, or affiliates. If you wish to receive messaging from another company, you must consent separately and directly with that company.

Message frequency & data rates.

Message frequency varies based on your loan stage but typically does not exceed 3–5 messages per week outside of notification events (such as a rate lock confirmation or closing reminder). Message and data rates may apply— consult your wireless carrier's plan terms.

Opt-out and HELP.

  • Reply STOP to any message to unsubscribe immediately. You will receive one final confirmation message and no further texts unless you opt back in.
  • Reply HELP for assistance, or contact us at privacy@lhfs.com or (800) 672-9470.
  • Opt-out is honored across all SMS campaigns associated with your number unless you specify otherwise.

Recordkeeping.

We retain all opt-in and opt-out records — including timestamps, opt-in method, and the campaign your consent applies to — in accordance with TCPA 2026 and Campaign Registry guidelines. These records are preserved for the period required by law and are produced upon lawful request.

Do Not Call.

National Do Not Call Registry protections apply to SMS as well as calls. We honor existing DNC registrations unless you have expressly opted into our messaging program. The federal registry is at donotcall.gov.

When we share information.

We do not sell your personal information. We share it only as necessary to originate, fund, and service your loan, to operate our SMS program, or to comply with the law.

  • Service providers. Appraisers, title and escrow companies, credit bureaus, document custodians, e-signature platforms, SMS gateways, and similar vendors — each bound by written confidentiality obligations consistent with the Gramm-Leach-Bliley Safeguards Rule.
  • Investors and servicers. Where a loan is sold or transferred, the information needed to service the loan is shared with the acquiring investor or servicer and a RESPA Notice of Servicing Transfer is sent to you at least 15 days before the effective date of transfer.
  • Government and regulators. As required for HMDA reporting, BSA/AML compliance, regulator examination, court order, subpoena, or similar lawful process.
  • Affiliates. We do not share your SMS consent with affiliates. Other personal information may be shared with corporate affiliates only as permitted by GLBA and described in our annual privacy notice.
  • With your consent. Any sharing not described above occurs only with your express, written consent.

Our websites use cookies and similar technologies for essential functionality, analytics, and marketing measurement. You can control cookies through your browser settings.

  • Essential cookies. Required for the site to function — session management, security, and load balancing. These cannot be disabled without breaking core functionality.
  • Analytics cookies. Used to understand traffic patterns and improve the user experience. Data is aggregated and does not, on its own, identify you.
  • Marketing cookies. Used to measure the effectiveness of advertising and to deliver relevant content. We do not place marketing cookies that share your identifiers with third parties without your consent where required.

How we protect your data.

We maintain administrative, technical, and physical safeguards designed to protect non-public personal information against unauthorized access, alteration, disclosure, or destruction — consistent with the GLBA Safeguards Rule and applicable state security standards. No system can be guaranteed perfectly secure, but our program is reviewed and tested on a recurring basis.

  • Encryption of data in transit (TLS) and at rest where applicable.
  • Role-based access controls and multi-factor authentication for employees with access to borrower information.
  • Vendor diligence and contractual safeguards for service providers handling your data.
  • Incident response procedures and breach notification consistent with state and federal requirements.

Your rights and choices.

Depending on your state of residence, you may have specific rights regarding your personal information. Below are the choices available to all applicants and borrowers, plus rights that apply under specific state laws.

  1. Access. Request a copy of the categories of personal information we maintain about you.
  2. Correction. Request that we correct inaccurate personal information in your loan file or contact record.
  3. Deletion. Request deletion of personal information not required to be retained under federal lending, recordkeeping, or anti-money-laundering laws.
  4. SMS opt-out. Reply STOP to any text message, or contact us at privacy@lhfs.com.
  5. Marketing opt-out. Opt out of non-essential marketing email and direct mail at any time.
  6. State-specific rights. California (CCPA/CPRA), Colorado (CPA), Connecticut (CTDPA), Virginia (VCDPA), and other state residents may have additional rights to portability, opt-out of certain processing, and non-discrimination for exercising those rights.   • For everyday business purposes — to process your transaction, maintain your account, respond to court orders or legal investigations, or report to credit bureaus. You cannot limit this sharing.
  • For our marketing purposes — to offer products and services to you. You may limit this sharing on request.
  • For joint marketing with other financial companies — we do not currently engage in joint marketing of this kind.
  • For affiliates' everyday business purposes — consistent with GLBA. You may limit this sharing on request to the extent permitted by law.
  • For non-affiliates to market to youwe do not share for this purpose.

Children's privacy.

Our websites and SMS program are directed to adults applying for or considering a residential mortgage. We do not knowingly collect personal information from children under 13. If we learn we have collected information from a child under 13 without verifiable parental consent, we will delete it. Parents or guardians who believe a child has provided information to us may contact privacy@lhfs.com.
